Terms​ ​and​ ​Conditions


1. TERMS OF USE
These Terms and Conditions apply to all services provided directly, or indirectly via the Internet, e-mail or phone, by Sun Spalato Apartments. By accessing, browsing, or using our website and/or making a reservation, you declare that you have read, understood, and agreed to set conditions set out by Sun Spalato Apartments.


2. CATEGORIZATION AND DESCRIPTION OF FACILITIES
Accommodation and facilities we offer have been described in accordance with the official categorization set by the Republic of Croatia, applicable at the time of program publication, and based on data by Sun Spalato Apartments. Sun Spalato Apartments assumes no responsibility for the information, in written or oral form, which is not in accordance with the description of services and facilities published in programs, and which has been received by a third party. Sun Spalato Apartments shall not be liable in case of incorrect information by business partners.


3. RESERVATION OF ACCOMMODATION
By making a reservation of accommodation, the guest enters into a direct, legally binding, contractual relationship with Sun Spalato Apartments.
Valid credit card data shall be given for confirmation of a reservation. Sun Spalato Apartments has the right to pre-authorize a credit card prior to the guest’s arrival.
In case that provided credit card data are not valid, we reserve the right to cancel such a reservation.
Reservations may be made online or through our chat on the official website www.sunspalato.com. We are also available on the e-mail address info@sunspalato.com


4. PRICE OF SERVICES
The current price of services is listed on our website www.sunspalato.com, as well as in the offer received via an online booking system or from a reservations department. In case of any changes or deviations from the booked service, the regular prices shall be charged.
A refund is not possible for services that have not been used.
All types of special services that are not included in the price shall be paid by the guest and the guest shall order them at the time of reservation or by making an inquiry on the location.
Prices in euros are used for informational purposes only.
We reserve the right to refuse, cancel, or modify a reservation in case there has been misuse of the reservation system or if the reservation has been an obvious mistake made by the user.
Prices include the cost of accommodation, VAT included the cost of electricity, heating, bed linen, towels, shower gels, shampoos, and final cleaning.
Free wireless Internet is available in all rooms and apartments. Sun Spalato Apartments shall not be held responsible for potential technical problems caused by a service provider.
Meals are not offered in the accommodation facilities.
Accommodation for one child under the age of 3 in a provided crib is free of charge.
Accommodation for one child under the age of 2 in a crib is free of charge.
A crib is available at the request, and its availability shall be confirmed by the check-in personnel of Sun Spalato Apartments.


5. PARKING
Prior to making a reservation for a private parking space at Sun Spalato Apartments, it is necessary to check its availability with the check-in personnel of Sun Spalato Apartments.


6. RESIDENCE TAX
The residence tax is included in the price of accommodation. The residence tax is 7.00 HRK per person/day. Children under the age of 12 are excluded from residence tax. Children from 12 to 18 years pay 50% of the residence tax, i.e. 3.5 HRK per person/day, pursuant to Article 4 of the Residence Tax Act.


7. ACCOMMODATION IN SUN SPALATO APARTMENTS
Placement in rooms is to be determined by the check-in personnel of Sun Spalato Apartments. If a guest has not explicitly requested a particular room, the guest shall accept any officially registered facility for rent in a particular building described in the catalog or price list.


8. PETS
Pets are not allowed in Sun Spalato Apartments.


9. CHECK-IN/CHECK-OUT
On the day of arrival, an apartment/room is at your disposal from 4 p.m. If your apartment/room is ready before, check-in personnel shall inform you accordingly in a timely manner.
Check-in time is between 4 p.m. and 10 p.m. Guests can check-in later than 10 p.m. if the apartment has a self-check-in option.
Check-out time is until 10:30 a.m. Late check-out may be arranged if the apartment/room is available. Availability shall be checked with the check-in personnel.


10. PERSONAL IDENTIFICATION
Guests are required to have valid identity documents. If in case of an invalid document a guest cancels a trip and therefore Sun Spalato Apartments suffers additional damage, the guest shall compensate for the damage. If a guest loses a passport during a trip or the passport is stolen, the cost of issuance of new documents shall be borne by the guest.


11. PAYMENT
Guests credit card will be pre-authorized for the full amount before arrival after the free cancellation period ends (14 days before arrival for apartments and 60 days before arrival for the villas)
Guests will be charged the total price of the reservation on the day of their check-in
Please note that your credit card will be charged in HRK (Croatian currency). Your bank hereinafter converts this amount to the currency of your domestic account. Due to your bank’s exchange rate, this may result in a slightly different (higher) total charge than the amount stated in HRK on our hotel invoice.


12. CANCELLATION POLICY
If you cancel 14 days prior to arrival to the apartment or 60 days prior to arrival to Villa, you won’t be charged for accommodation, unless otherwise stated in the cancellation policy when making your reservation.
For cancellation of a reservation within fourteen (14) days of arrival for apartments or sixty (60) days of arrival for Villas, or in case of a no-show, guests shall be charged with the full amount (100%).


13. HOUSE RULES
In order to ensure a pleasant stay in Sun Spalato Apartments for all guests as well as to prevent any potential disagreement, all guests shall read the House Rules. Upon reservation confirmation, it is implied that you have understood all segments of the House Rules and that you will fully adhere to them.
If the guest notices faulty or damaged items they shall notify Sun Spalato Apartments representatives in order to fix the damage as soon as possible.
Guests shall be charged for all damage to items, whether it was made intentionally or unintentionally.
Please use energy rationally.

Guests shall leave apartments and rooms clean before check-out, take out the garbage, and put it in the provided green trash cans in front of the building.
During their stay, guests shall adhere to the House Rules, which stipulates that loud music and parties are STRICTLY FORBIDDEN.
Violations of the House Rules may result in a police report being filed by tenants, as well as the loss of the rent paid in the event of damage.
Prohibited times for residential noise are every day from 14.00 to 17.00 and from 23.00 to 8.00.
We highly appreciate your cooperation and hope that you understand that all these rules are obligatory, given that Sun Spalato Apartments is located in residential buildings, and that afternoon and night rest of other tenants must be respected.


14. COMPLAINTS
It is in our best interest to keep the guests satisfied and immediately resolve any complaints at the location. If the situation does not improve after a complaint, the guest shall ask for a confirmation stating that the service was not provided, or that it was not provided in an agreed-upon manner. The guest shall attach the confirmation to a written complaint. The guest shall file a written complaint within 8 days from the end of the trip. If a guest files a written complaint outside of this period, Sun Spalato Apartments shall not be obliged to take the complaint into consideration. Sun Spalato Apartments is required to provide a written response to such a complaint. Sun Spalato Apartments shall respond only to complaints that could not be resolved on the spot. During the process of decision making, the guest irrevocably waives the right to mediation by a third party, arbitration by any institution as well as the right of giving information to the media. Additionally, the guest waives the right to file a civil action. The maximum amount of compensation per complaint may reach the amount of the advertised part of services, and it shall not include the service which has been used or the entire amount of the arrangement. The guest and Sun Spalato Apartments shall attempt to resolve disputes amicably, but failing to do so, the parties agree to the jurisdiction of the County Court in Split. Governing law is Croatian law.


15. RESPONSIBILITIES OF SUN SPALATO APARTMENTS
Sun Spalato Apartments shall take care of the performance of services, as well as the selection of service providers, with due diligence of a prudent businessman. Sun Spalato Apartments shall also care about the rights and interests of guests, in accordance with good practices in tourism. Sun Spalato Apartments shall provide all contractual services of a particular arrangement to the guest and give reasons for any failure to provide services or a part of services. All of the above-mentioned obligations from programs shall be performed fully and in a described manner, except in case of force majeure, adverse weather conditions, or changing circumstances. If possible, in such cases Sun Spalato Apartments shall offer a replacement solution. Sun Spalato Apartments is not required to provide services outside of these Terms and Conditions. Sun Spalato Apartments shall not be responsible for the loss of valuables and personal belongings of guests.


16. RESPONSIBILITIES OF GUESTS
Guests shall make sure that they personally meet all requirements set out by regulations of the Republic of Croatia and adhere to the House Rules of Sun Spalato Apartments. Guests shall be held responsible for the damage caused. The cost of damage caused shall be paid by the guest from the deposit. The loss of key/keycard shall be charged 35 EUR. The loss of the garage key shall be charged 50 EUR.

SUNČANI SPLIT d.o.o. The trademark, trade name, service mark, logo, symbol, or other protected material are property to SUNČANI SPLIT d.o.o. The company owns copyrights to Sun Spalato Apartments/Sun Spalato Apartments. You may not use the intellectual property of SUNČANI SPLIT d.o.o. without our consent. The website contains copyrighted material, trade names, or other protected information, including, but not limited to text, software, charts, and could include video, graphs, music, and sound in the future. It is not allowed to change, publish, transfer, participate in a transfer or sale, create derivative works, or utilize a part or entire content in any way. SUNČANI SPLIT d.o.o. The company assumes no responsibility for copyrighted materials offered by third parties or misuse of intellectual property by third parties. Information on the Sun Spalato Apartments/ Sun Spalato Apartments website is for personal use only. 18. PRIVACY
Sun Spalato Apartments shall retain any personal data you provide during the use of our website or when making a reservation via other online booking systems. Personal information may include your name, address, telephone number, credit card number, and email address. In order to prevent unauthorized access, we perform physical, electronic, and organizational procedures, thus protecting personal information from accidental or unlawful destruction, accidental loss, modification, and unauthorized disclosure or access. Sun Spalato Apartments uses personal information and other data collected on the website in order to: (a) provide requested products and services (mostly for the purpose of processing your reservation) and, (b) provide information about our products and services. Sun Spalato Apartments do not share your personal information with third parties. Sharing certain personal information with selected partners, when necessary, shall not be disclosed to third parties without your consent.
